This is an important section of the Primeight Digital Co., ltd and trading names primeightdigital.com and Primeight or Primeight Digital (“The Company”/”We”) site explaining the terms and conditions you are agreeing to when you use and/or shop from the company's website.
These Terms and Conditions apply to all transactions though Primeight Digital. Please read them carefully before purchase. All statements, guarantees or warranties in our Terms of Trading are in addition to and do not affect your Statutory Rights.
Primeight Digital may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted onto the site.

1. Limitation of Liability

1.1 Nothing in this Agreement shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of Primeight Digital.

1.2 By agreeing to these Terms and Conditions, you agree that Primeight Digital shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the internet not under Park Cameras 's direct control including, without limitation, damage for loss of business, loss of sales, non-payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where Primeight Digital has been advised of the possibility of such loss or damage).

2. Missing Items

2.1 Customers are expected to report any missing items from their order promptly after delivery. This also has to be verified by Primeight Digital stock.

2.2 Customers must inform us within 2 days if you have not received your delivery. Our customer service team will need to investigate any missing deliveries with the relevant courier, and whilst we will endeavour to complete this as quickly as possible, this may cause a delay to your order.

2.3 Customer must advise us of any items missing from their order within 2 days of receipt, so that Primeight Digital may investigate and cross-check against our internal stock and despatch records.

3. Operation

3.1 All prices are displayed in US Dollars. All prices are expressed inclusive of any VAT payable unless otherwise stated.

3.2 All brand names are trademarks of their respective companies.

3.3 Product images featured on the site are for guidance only and are not always an exact match of a product. Availability of a product cannot be guaranteed.

3.4 We operate 7 days a week and orders received after 4pm will be processed on the next business day. Before placing an order, the customer will be requested to accept/decline our terms and conditions. Orders will only be processed if acceptance is indicated and therefore the customer is deemed to have accepted these terms and will abide by them.

3.5 The placing of an order represents an offer to purchase the products indicated by the customer and is not binding on us until the order is accepted and despatched by us. If a product shown on the website is unavailable, incorrectly priced or incorrectly described, we shall not be obliged to sell you the product.

3.6 An acknowledgement of your order will be sent to you via email when you place you purchase online, but acceptance of your offer to buy the Goods will not take place until payment is taken. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.

3.7 Customers have the chance to change and amend any part of their order until they press the 'submit order' button. We will send you an email confirming your order. Primeight suggest that you print off a hard copy of the order, or save a copy to your hard drive for future records.

3.8 Payment for goods must be received before an order is despatched. Please allow seven days for cheques to clear before goods are sent. We do not accept sending cash as a method of payment and cannot be held responsible for any loss during transit.

3.9 We reserve the right to refuse to sell an Item, if we feel that the product or the price for such product has been put on to the website in error. Please note that products, prices and offers in our store may differ from those featured on this Site and vice versa.

4. General

4.1 In the unlikely event that an incorrect price is shown on our website, Primeight Digital reserve the right to abstain from fulfilling the order at that price. You will of course be notified, at which point you will be informed of the correct price, and be given the choice to proceed with the order. Primeight Digital make every effort to get the original details correct, but take into consideration different situations. No contract exists between the customer and Primeight Digital for the sale of any goods or services until we have received and accepted your order and we have received payment in full (in cleared funds). Once we do so, there is a binding legal contract between us. Please note that products, prices and offers in our store may differ from those featured on this Site and vice versa.

4.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you as soon as possible.

4.3 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. This would be within 30 days. Further delays or longer initial lead times would be communicated either at the time of placing the order or by a secondary communication.

4.4 Most goods supplied by Primeight Digital come with a half year manufacturer’s warranty; in some cases it is longer. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, and negligence by you or any third party, use otherwise than as recommended by Primeight Digital, failure to follow the Primeight Digital’s instructions, or any alteration or repair carried out without Primeight Digital’s approval.

4.5 We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.

4.6 Except as expressly set out in these Terms and Conditions, all use of your personal information will be made in accordance with our privacy policy.

5. Delivery

5.1Delivery will be made to the address specified when you complete your order. We use a variety of delivery methods, depending on the size of the Item you order and the speed with which you wish to receive it. Whilst we make every effort to deliver all your Items within 15 days of the date of your order, we shall not be liable if we fail to do so in part or in full due to circumstances beyond our control. We shall contact you to let you know if we are having any problems getting an Item to you within that time. Sometimes a signature is required at delivery. By placing an order you are authorising us to accept signature from another person on your behalf if you need to sign for an Item and you are not present at the time of delivery.

5.2 When an Item is delivered, risk of damage to or loss of the Item passes to you.

6. Cancellation Rights

6.1 Distance buying regulations provide a cooling off period (not a try before you buy period) and a right to cancel your order should you decide not to complete the transaction. The cooling off period begins the day after your goods are received and ends 7 working days later. The regulations require the customer to contact us in writing to notify us of the intent to cancel/return the goods. We cannot accept returns/cancellations if we have not been notified in writing before this period has lapsed. Email is an acceptable way to notify us and we will confirm that we have received such communication. If an order is cancelled within this cooling off period we would expect the goods to be returned to us before we process any refund. We do not refund carriage costs. We also expect goods to be returned in pristine condition with the original packaging and contents and must not be used in a way that constitutes acceptance by the customer.

6.2 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Primeight Digital at your own cost. The goods must be returned to the address below (HongKong) and you must take reasonable care to ensure the goods are not damaged in the meantime or in transit.

6.2a Please remove all unnecessary pre-existing labels from the box.

6.3 You cannot cancel your contract:

a) If you have used the Item(s);

b) If you have taken any software out of the sealed package in which it was delivered to you;

c) If the Item(s) are film, sensitised materials, developing or printing matter;

d) If the Item(s) were made to your individual specification or personalised at your instruction.

7. Claims

7.1 No liability for any claim for damage or non-functionality shall be accepted unless Primeight Digital are notified in writing by the purchaser within 3 days of your delivery. This period may be extended at the sole discretion of Primeight Digital where the manufacturers' replacement exceeds this deadline.

7.2 No liability for any claim for missing items. shall be accepted unless Primeight Digital are notified in writing by the purchaser promptly after delivery.

7.3 No liability for any claim will be accepted in the case of goods differing in quantity or descriptions from the particulars given on the delivery note, unless Primeight Digital are notified in writing by the purchaser promptly after delivery and the onus is on the purchaser to prove any shortage.

8. Returned Goods

8.1 Primeight Digital will not accept goods for credit or rectification unless Primeight Digital have been notified beforehand by email or telephone or whatsapp and the goods are received by Primeight Digital in stock condition with original packaging. Primeight Digital reserves the right to reject returns based on a change of mind without any defect present as per the Consumer Guarantees Act.Primeight Digital retain the right at our sole discretion whether to accept the return of the goods, or whether to rectify the goods or whether to issue a credit note in respect thereof. Stock condition would be described as the product being in pristine condition with all software seals intact, supplied with all the original accessories and packing and not registered for warranty with the manufacturer.

8.2 The purchaser shall unless otherwise stated be responsible for the cost of outward and return carriage and insurance of all goods returned by the purchaser to Primeight Digital for service or credit. Goods shall be at the risk of the purchaser until actual receipt of the goods by Primeight Digital. The onus of proof of safe delivery shall rest with the purchaser.

8.3 All items returned to Primeight Digital by pre-arrangement and found to contain no fault will need to be verified as stock condition by Primeight Digital.

8.4 Credits and refunds will be processed within 30 days.

8.5 Please remove all unnecessary pre-existing labels from the box.

8.6 Merchandise missing the original Universal Product Code (UPC) cannot be returned. The original manufacturer's labeled packaging should be enclosed within an outer shipping box. Please do not write or place shipping labels or stickers on the manufacturer's packaging.

9. The Company’s Liability

9.1 We have taken every care in the preparation of the content of the Site. However, we cannot guarantee uninterrupted and totally reliable access to the Site, and so therefore cannot guarantee that the information will always be completely up to date and free of mistakes. If a fault occurs in the service, you should report it to us either by whatsapp : +852-55671128 or by e-mail at [email protected] and we will attempt to correct the fault as soon as we reasonably can. Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. The Company will attempt to restore the service as soon as it reasonably can.

9.2 To the extent permitted by applicable law, the Company disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on the Site and the Company will not accept any liability for any loss or damage arising as a result of problems with access.

9.3 The Site may provide content from other Internet sites or resources and while the Company tries to ensure that the material included on the Site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. The Company will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Site. If the Company is informed of any inaccuracies of the material on the Site, we will attempt to correct the inaccuracies as soon as we reasonably can. In particular, we disclaim all liabilities in connection with the following:

a) Incompatibility of the Site with any of your equipment, software or telecommunication links;

b) Technical problems including errors or interruptions of the Site;

c) Unsuitability, unreliability or inaccuracy of the Site; and

d) Inadequacy of the Site to meet your requirements.

9.4 To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss or privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site.

9.5 Nothing in these Terms and Conditions shall exclude the Company’s liability for personal injury or death caused by its negligence.

9.6 Primeight Digital is excluded from any liability to the purchaser for; losses that were not foreseeable to both parties when the contract was formed; losses that were not caused by any breach on the part of the supplier; business losses, and/or losses to non-consumers.

10. Trade Marks and Copyright

10.1 All brand names, product and service names and titles and copyrights used in this Site are trademarks, trade names, service marks or copyrights of their respective holders. No permission is given by the Company for their use by any person other than the said holders and such use may constitute an infringement of the holders’ rights.

10.2 All designs, text, graphics and their selection and arrangement on this Site are the copyright of the Company. Permission is granted to users to electronically copy or print portions of this Site for their own personal, non-commercial use. Any other use of materials on this Site without the Company’s prior written consent is strictly prohibited. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Site without written permission from the Company.

10.3 No license is granted to you in these Terms and Conditions to use any trade mark of the Company.

10.4 You may not use the Site for any of the following purposes:

a) Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable materials;

b) Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

c) Gaining unauthorised access to other computer systems;

d) Interfering with any other persons use or enjoyment of the Site;

e) Breaching any laws concerning the use of public telecommunications networks;

f) Interfering with or disrupting networks or websites connected to the Site;

g) Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
